The protection action as a jurisdictional guarantee against the violation of the right to freedom of worship in Ecuador

Abstract

The present research is framed in carrying out an analysis regarding one of the jurisdictional guarantees stipulated in the Constitution of the Republic of Ecuador in cases of violation of the right to freedom of worship in Ecuador specifically the recourse of Action of Protection and its effectiveness in the resolution of conflicts. For the validation of the information provided to the research, analysis of sentences inherent to the field of freedom of worship was carried out, on the other hand, the methodology is based on a qualitative approach which allowed obtaining relevant information, through bibliographic research, laws and mainly through the analysis of court rulings. Regarding the discussion, freedom of worship must be guaranteed because it is a constitutional right and as a conclusion it was determined that the guarantee of Protection Action is a means to achieve justice, because the cases presented in this research show that the appropriate use of it by the judges can fulfill its purpose of direct and effective protection of the rights recognized in the Constitution.
